Delaware Supreme Court upholds Superior Court's judgment in favor of SARN SD3, affirming a $3.4 million award against Czechoslovak Group.
WILMINGTON, DE / ACCESSWIRE / September 27, 2024 / The Delaware Supreme Court (Case: 294,2023C) has upheld the Superior Court's judgment in favor of SARN SD3 LLC, affirming a $3.4 million award against Czechoslovak Group a.s. This decision marks a decisive conclusion to legal proceedings initiated in 2017, following a breach of contract by Czechoslovak Group a.s.
The original ruling, delivered by Judge Eric M. Davis of the Superior Court of Delaware, was part of a broader legal action brought by SARN group companies against Czechoslovak Group companies. In a separate but related case, the Superior Court of Delaware also awarded $960,000 to SARN ENERGY in 2019 after Tatra Defence Vehicle a.s. requested a judgment be entered against it shortly before trial.
"This ruling is a powerful validation of SARN's position," said Armen Agas, Deputy to the Chairman of SARN Group. "Through an exhaustive review of hundreds of documents and testimony from many witnesses, the courts have repeatedly affirmed that SARN acted in good faith, while Czechoslovak Group failed to meet their contractual obligations. Despite CSG's attempts to cloud the facts, Delaware-recognized globally as the premier forum for business litigation-has once again ensured that justice prevails."
Agas further emphasized the significance of meticulous documentation and transparent legal processes in dealing with the Czechoslovak Group. "This victory would not have been possible without our robust contractual framework and clear documentary evidence. Had it not been for these critical factors, Czechoslovak Group's intense efforts to shirk their contractual obligations may have succeeded."
In light of their legal losses, Czechoslovak Group has attempted to divert attention by falsely accusing SARN of using litigation as a tool for extortion. To address these defamatory claims and protect its reputation, SARN has filed a new lawsuit in the Superior Court of Delaware (Case: N24C-04-284 EMD CCLD), seeking damages for defamation.
More concerning is a coordinated disinformation campaign targeting SARN, reportedly orchestrated by pro-Russian figures within the Czech administration.
Stephen Richards, Chairman of SARN Group, commented: "Our investigation has uncovered evidence that elements within the Offices of then President Zeman and Prime Minister Fiala have initiated and supported disinformation efforts directed against SARN. We will take all necessary action that we are legally entitled to protect our interests."
