San Francisco Personal Injury Attorney Teresa Li Obtains $1,500,000 Against Farmers Insurance In a Parking Lot Low Impact Car Accident Case

SAN FRANCISCO, CA / ACCESSWIRE / May 21, 2024 / In the afternoon of October 4, 2024, Li's client, a 68-year-old real estate agent/property manager/loan originator and a breast cancer survivor was on her way out of a Safeway parking lot in San Mateo, when she was hit on her driver side by an elderly driver who was making a left turn. After the impact, the elderly driver was rude and refused to give Li's client her driver license information or her car insurance policy number.

In the next two days after the collision, Li's client's condition rapidly worsened, and on day three, she was rushed to the hospital for severe sepsis. She stayed in the hospital for seven days. It turns out because Li's client was a cancer survivor and because she had diabetes and was on blood thinner medications, Li's client was more susceptible to seatbelt injury than a normal healthy person. Li's client sustained two hematomas (blood clots) from the seatbelt injury: one in her left breast and one in her right pelvis. The hematoma caused infection to her bladder which threw her into sepsis. In the next three years, Li's client was in and out of hospital for a total of eight breast surgeries, trying to remove the hematoma. Eventually, the doctor decided to perform a complete mastectomy of her entire left breast.

The elderly driver's insurance is Farmers Insurance. After unable to receive any offer pre lawsuit from Farmers insurance, Li filed the lawsuit in San Mateo Superior Court on June 8, 2022, Chang v. Webb , case No. 22CIV02340. Shortly after the lawsuit was filed, Farmers Insurance's last offer was $100,000. Farmers Insurance disputes the severity of the injury, brushing it off as a low impact collision--it claims the difference in impact speed is only 3 miles per hour and car repair only costs a couple of thousand dollars.

After reviewing thousands of pages of medical records, consulting with the best medical experts in the area, and deposing treating doctors, Li was able to make Farmers Insurance pay its policy limit of $1,5000,000 to Li's client on the eve of trial. The settlement was reached on May 8, 2024.
