CONSOL Energy Inc. (the Company) issued a press release on January 29, 2009 announcing its results for the fiscal year ended December 31, 2008. A copy of the earnings release is attached to this Form 8-K as Exhibit 99.1.

Item 8.01 | Other Events. |
On January 7, 2009, the Companys publicly traded subsidiary, CNX Gas Corporation (CNX Gas), received a civil investigative demand for information and documents from the Attorney General of the Commonwealth of Virginia regarding CNX Gas exploration, production, transportation and sale of coalbed methane gas in Virginia. According to the request, the Attorney General is investigating whether CNX Gas may have violated the Virginia Antitrust Act. The request for information does not constitute the commencement of legal proceedings and does not make any specific allegations against CNX Gas. CNX Gas does not believe that it has violated the Virginia Antitrust Act and CNX Gas intends to cooperate with the Attorney Generals investigation.
